अयोध्या में राम मंदिर बनाने को लेकर मोदी सरकार ने बड़ा फैसला लिया है. सुप्रीम कोर्ट के आदेश के अनुसार केंद्रीय कैबिनेट ने बुधवार को राम मंदिर ट्रस्ट बनाने को मंजूरी दे दी है. प्रधानमंत्री नरेंद्र मोदी ने लोकसभा में राम मंदिर ट्रस्ट बनाने का ऐलान किया. इस ट्रस्ट का नाम ‘श्री राम मंदिर तीर्थ क्षेत्र’ रखा गया है. लोकसभा में पीएम ने इसके साथ ही अयोध्या में सरकार द्वारा कब्जाई गई 67 एकड़ जमीन को भी ट्रस्ट को देने की बात की |
यहां हम आपको बता रहे हैं कि ट्रस्ट कैसे बनते हैं, कितने प्रकार के होते हैं, इसकी क्या पावर होते हैं, इसमें आया पैसा किस तरह से इस्तेमाल होता है, अगर कोई हेरफेर हुआ तो ट्रस्ट के कौन से लोग इसके लिए जिम्मेदार होते हैं |
कितने प्रकार के होते हैं ट्रस्ट
ट्रस्ट तीन प्रकार के होते हैं जो कानूनी तौर पर पंजीकृत किए जाते हैं. ये तीन प्रकार हैं चैरिटेबल रिलीजियस और प्राइवेट ट्रस्ट, ये कुछ इस तरह कार्यान्वित होते हैं |
प्राइवेट ट्रस्ट- ये ट्रस्ट माइनर बच्चों के लिए या फैमिली के लिए बनाए जाते हैं. इसमें लाभार्थी बच्चे ही होते हैं. ये किसी तरह की प्रॉपर्टी लेने या किसी बिजनेस आदि के लिए बनते हैं. इसमें बच्चों को ही आगे चलकर पावर ऑफ अटॉर्नी मिलती है |
चैरिटेबल ट्रस्ट- ये ट्रस्ट जनरल पब्लिक इन लार्ज यानी सामान्य जनता के लिए बनाए जाते हैं. ये ट्रस्ट सभी धर्म के लोगों के लिए होता है, इसे एनजीओ भी बोलते हैं, ये ट्रस्ट अपनी सेवाएं देने में जाति-धर्म, लिंग या किसी तरह का भेद नहीं कर सकते है. इस ट्रस्ट में पावर ऑफ एटार्नी भिन्न तरह के लोगों के पास होती है. इसके पंजीकरण के नियम में ही ये बात स्पष्ट होती है कि इसमें एक परिवार के बजाय अलग अलग लोग हों. इसे सामान्य भाषा में एनजीओ (Non-Governmental Organisation) कहा जाता है |
धर्मार्थ ट्रस्ट: अब बात करते हैं धर्मार्थ ट्रस्ट जो अंग्रेजी में रिलीजियस ट्रस्ट होता है. ये ही ट्रस्ट राम मंदिर निर्माण के लिए बनाया गया है. मुस्लिम समुदाय इसी की तर्ज पर वक्फ बोर्ड बनाते हैं. वक्फ बोर्ड भी इसी कानून के तहत बनता है. धर्मार्थ ट्रस्ट का मुख्य कार्य धार्मिक कार्यों का बढ़ावा देना और धार्मिकस्थलों की देखरेख और सुरक्षा करना होता है |
इनकम टैक्स धारा 12 ए के तहत इनकी इनकम टैक्स फ्री हो सकती है. लेकिन दानदाता को 80 जी के तहत छूट नहीं मिलती. धमार्थ ट्रस्ट का सीधा मकसद होता है कि हम अपने धर्म को प्रमोट करें, उस धर्म के लिए और भी मंदिर बनाएं देखरेख करें
कमेटी करती है देखभाल
इसे मैनेजमेंट कमेटी या मैनेजमेंट बोर्ड बोलते हैं, कहीं-कहीं इसे गवर्निंग बॉडी भी बोलते हैं. ये ट्रस्टी से ज्यादा पावरफुल होते हैं. जैसे ट्रस्ट बनने के बाद जो लोग भी इसमें होंगे, वे इन्हीं सदस्यों में से पदाधिकारी चुनेंगे. ट्रस्टी की पावर उनके पद के आधार पर होगी. सरकार जब कोई ट्रस्ट बनाती है तो वही डिसाइड करती है कि कौन ट्रस्टी रहेगा |
कैसे काम करेगा राम मंदिर तीर्थ स्थल ट्रस्ट
प्रधानमंत्री नरेंद्र मोदी ने जिस राम मंदिर तीर्थस्थल ट्रस्ट की घोषणा की है वो धर्मार्थ बोर्ड की तरह काम करेगा. इसके लिए सबसे पहले ट्रस्टी बोर्ड बनाया जाएगा. इस बोर्ड में 10 से 15 लोग रखे जाते हैं. ये ट्रस्टी बोर्ड मिलकर मैनेजमेंट बोर्ड या गवर्निंग बॉडी तैयार करेगा. जो लोग भी इस बॉडी या बोर्ड में होंगे, उन्हें ही सारे अधिकार होंगे कि वो आगे क्या डिसीजन लेंगे |
कैसे होगा पैसे का इस्तेमाल
इस ट्रस्ट में एक निश्चित तरीके से जनता से पैसा लिया जाएगा. इसके लिए जितना भी पैसा आएगा. वो एक बैंक खाते में जमा होगा. ये पैसा उस खाते में जमा होगा जो कानूनी रूप से बोर्ड के डिसीजन के अनुसार मुख्य पदाधिकारी होगा |
कौन होगा गड़बड़ी का जिम्मेदार या जवाबदेह
बोर्ड द्वारा दिया गया खाता एक पैन नंबर से खोला जाता है. ये जिसका पैन नंबर होगा, उसी को सबसे ज्यादा जिम्मेदार माना जाएगा. इस व्यक्ति का चयन भी बोर्ड करता है. इसलिए लीगल एंटिटी बोर्ड के पास ही रहती हैं. ट्रस्टी जिसे लीगल एंटिटी यानी कानूनी अधिकार देते हैं, वही इस मामले में पूरी तरह जवाबदेह होता है और अगर कोई गड़बड़ी हुई तो वही जिम्मेदार होता है |
कैसे दी जाती है Legal Entity(कानूनी इकाई)
बता दें कि ट्रस्ट के गठन के बाद सबसे पहले उसकी डीड तैयार होगी. डीड का अर्थ उस ट्रस्ट के मुख्य उद्देश्य से है. इसके साथ ही ट्रस्ट के रूल्स एंड रेगुलेशन तय किए जाएंगे. फिर ट्रस्टी द्वारा चयनित बोर्ड में से कुछ लोगों को लीगल एंटिटी यानी कानूनी इकाई बनाया जाएगा. इसके बाद बोर्ड रिजोल्यूशन पास करके किसी को भी इसका अधिकार दे सकता है लेकिन जिम्मेदार ट्रस्टी ही रहेंगे, क्योंकि वो ही उस व्यक्ति को ये अधिकार देंगे |
